Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the BRAWLER AI application, website, and related services (collectively, the "Service") provided by BRAWLER AI, operated by Brendan McWeeney, a sole proprietor based in California, United States ("we," "our," or "us"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. The Service

BRAWLER AI is a Brazilian Jiu-Jitsu training journal that uses artificial intelligence to help you log training, track techniques and sparring, and receive personalized coaching insights. We may add, change, or remove features over time.

The Service includes AI-generated content. AI output can be inaccurate or incomplete, and you should use your own judgment before relying on it.

3. Eligibility and Accounts

• You must be at least 16 years old to use the Service.
• You are responsible for the accuracy of your account information and for keeping your credentials secure.
• You are responsible for all activity that occurs under your account.
• Notify us promptly of any unauthorized use of your account.

4. Subscriptions, Billing, and Renewals

BRAWLER AI offers an optional paid subscription ("Pro"). Subscriptions are billed in advance on a recurring basis through the platform you purchased on (the Apple App Store, or our web checkout provider).

4.1 Auto-Renewable Subscriptions

• Your subscription automatically renews for the same term unless you cancel it at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours before the end of the current period, at the price and billing interval shown at the time of purchase.
• The subscription title, length, and price are presented to you at the point of purchase and within the app before you subscribe.
• You can manage or cancel your subscription, and turn off auto-renewal, in your App Store account settings (or, for web subscriptions, in your billing settings).
• Deleting the app does not cancel your subscription.

4.2 Apple App Store Purchases

Subscriptions purchased through the Apple App Store are processed by Apple and are also subject to Apple's Standard End User License Agreement (EULA). Where Apple's terms apply to an App Store purchase and conflict with these Terms, Apple's terms govern that purchase. Apple is not responsible for the Service.

4.3 Refunds

Except where required by law, payments are non-refundable. Refund requests for App Store purchases are handled by Apple in accordance with Apple's policies.

5. Not Medical or Professional Advice

BRAWLER AI is a training and journaling tool. It does not provide medical, health, legal, or professional advice, and it is not a substitute for consultation with a qualified professional or a certified BJJ instructor.

Brazilian Jiu-Jitsu is a physical contact activity that carries inherent risk of injury. You are responsible for training safely and within your limits. Consult a healthcare provider before beginning or changing any training program.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Attempt to access, probe, or disrupt the Service, its infrastructure, or other users' data.
• Reverse engineer, scrape, or build a competing product from the Service except as permitted by law.
• Upload content that is unlawful, infringing, or harmful, or that you do not have the right to share.
• Misuse AI features to generate harmful, deceptive, or abusive content.

7. Your Content

You retain ownership of the content you create in the Service, including journal entries, recordings, and transcripts ("Your Content"). You grant us a limited, non-exclusive license to host, process, and display Your Content solely to operate and improve the Service for you, including generating AI insights from it.

We do not sell Your Content, and we do not use it to train third-party AI models. Our handling of Your Content is described in our Privacy Policy.

8. Intellectual Property

The Service, including its software, design, and branding, is owned by us and protected by intellectual property laws. These Terms do not grant you any right to our trademarks or branding without our prior written consent.

9. Third-Party Services

The Service relies on third-party providers (for example, hosting, payment processing, and AI model providers). Your use of those services may be subject to their own terms, and we are not responsible for third-party services.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that AI output will be accurate.

11. Limitation of Liability

To the fullest extent permitted by law, BRAWLER AI will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. You can delete your account at any time; certain provisions (such as intellectual property, disclaimers, and limitation of liability) survive termination.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date above and, where appropriate, notify you in the app. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws principles, except where applicable consumer-protection law provides otherwise.
